Family of Cincinnati Woman Suing Officer for Wrongful Death

On October 13th, a Cincinnati, Ohio resident called the police and stated she was arguing with her sister over gas money.  She also stated her sister was trying to break into her apartment.  When police arrived on the scene, they saw the sister loading items into her car, and the resident standing on the balcony of her apartment.  Officers went on to observe the sister attempting to leave, which would have solved the problem.

Matters became worse when the resident came barreling out of her apartment towards the driver’s side of her sister’s vehicle with a butcher knife in her hand.  Police report that they repeatedly warned the resident to put the weapon down, and she continuously refused.  According to police reports, the resident then made slashing motions towards her sister’s tires.  The police continued to try to get the resident to put the weapon down.  When the resident refused to drop the weapon, she turned to face the officer, challenged him, and raised the knife as she moved toward him.  Police report that the officer, fearing for his life and the safety of surrounding officers and citizens, shot the resident.

The resident passed away after the shooting, which prompted her family to file a wrongful death lawsuit against the officer in federal court.  The wrongful death suit claims that the resident was deprived due process and accuses the officer of using excessive force.  The family is denying the factual account of what occurred, stating that the resident’s only intent was to slash her sister’s tires.
