Court Hearings in Ohio for Designating a Dog as Vicious, Dangerous or Nuisance

vicious dog designationIn Ohio, a county dog warden may officially designate a dog as a nuisance dog, dangerous dog, or vicious dog if the dog warden has reasonable cause to do so.  If the dog warden does designate a dog as either a nuisance, dangerous, or vicious dog, the dog warden must notify the dog’s owner of the designation and that the owner may request a hearing regarding the designation.  Such notice must be by certified mail or in person.

If a dog owner disagrees with the dog warden’s designation of his or her dog as a nuisance, dangerous, or vicious dog, the owner may request a hearing within 10 days of receiving notice from the dog warden.  The request must be in writing and filed with the local court.  At the hearing, the dog warden has the burden to prove, by clear and convincing evidence, that the dog is a nuisance, dangerous, or vicious dog.  Both the dog owner and the dog warden may appeal the court’s decision to the appeals court.

If a dog owner requests a hearing, the court may, upon motion of the dog owner, allow the dog to remain in possession of the owner until the court makes a final determination and during the pendency of any appeal.  However, if the dog does remain in the owner’s possession, the dog must be properly confined at all times.  If the court ultimately determines the dog to be either a nuisance, dangerous, or vicious dog then the dog’s owner must comply with Ohio laws applicable to owners of those types of dogs.
