Wrongful Death Suit Allowed for Murdered Ohio Marine

wrongful deathAfter almost two years of waiting, Marine Corps Lance Cpl. Maria Lauterbach’s family can finally begin its wrongful death lawsuit.

In August 2010, a North Carolina jury convicted former Marine Cesar Laurean of first-degree murder for the bludgeoning death of Lance Cpl. Lauterbach of Vandalia, Ohio.  Laurean was sentenced to life in prison without parole.  In December 2007, Lance Cpl. Lauterbach, who was about 8-months pregnant, went missing.  It was rumored she was preparing to testify about being raped by a senior Marine officer.

The remains of Lauterbach and her unborn child were found in Corporal Cesar Armando Laurean’s backyard, charred in his fire-pit.  Authorities also found traces of Lauterbach’s blood throughout Laurean’s North Carolina home.  It was rumored that Laurean had planned on calling the death a suicide, but it was determined that the laceration on Lauterbach’s throat was post-mortem.  Authorities determined the cause of death was blunt-force trauma to the head, caused by a crowbar.

Laurean escaped the United States and fled to Mexico, only to be apprehended and extradited after North Carolina prosecutor’s agreed not to seek the death penalty.

On Monday, August 27, 2012, the North Carolina Supreme Court ruled against Laurean’s appeals, which were based on unconstitutionality.  This ruling will allow Lauterbach’s family to proceed with a wrongful death lawsuit against Laurean and his wife, as Laurean has exhausted his state court appeals.  The wrongful death suit accuses, among other things, that Laurean and his wife conspired to conceal the murder. It is unknown whether Lauterbach’s family will seek damages for the unborn child.  North Carolina, like Ohio, permits a wrongful death action on behalf of the unborn child if the child was viable at the time of his/her death.
