Watch What You Post on Social Media Sites After a Car Accident

car accidents and social mediaSocial media has quickly become a powerful communication tool – Facebook and Twitter are among the hottest ways to communicate.  Many employers, government agencies and schools are checking the social media history of an applicant during their hiring and admissions processes.  Now you can add judges to the mix, as they have started checking into status updates of the accused that stand before their courts.

In Kentucky, a woman was allegedly driving under the influence of alcohol.  She then struck a car filled with teenagers, and fled the scene of the auto accident.  She was apprehended and cited for DUI and causing the automobile accident.  After she was released from her initial detainment, she went home and jumped on Facebook.  While on the popular social-media website, she wrote a nonchalant “status update” about her car accident and charges:

“My dumb (expletive) got a dui and I hit a car…lol.”

The parents of the accident victims happened to see the Facebook status update, and approached the judge.  They asked that the objectionable Facebook page be taken down in its entirety, and the judge happily complied.  However, while the accused did publicly apologize, she did not completely delete her Facebook page.  In response, the judge held the woman in contempt of court, and sentenced her to two days in jail.

“I didn’t think ‘lol’ would put me in jail.”

This ruling raises interesting constitutional issues, as it is unclear whether the judge’s decision is in violation of the woman’s first amendment right to free speech.  One thing is for sure, posting details about your car accident and subsequent charges for the world to see is not the brightest move.
