rental car after car accidentCar accident victims face several hardships in the aftermath of their car wrecks.  Often times they have to deal with physical injury, loss of personal property and unexpected medical bills.  One of the most frustrating consequences of an automobile accident is the loss of their personal vehicle use.  It’s easy to take for granted the convenience of being able to go where you want, when you want.  Only after your vehicle is taken away do you realize how much you actually rely on it.

Supplying a rental car after an auto accident is an almost essential service provided to accident victims by insurance companies.  But how does someone know if they are entitled to a rental car?  The answer:  insurance companies have an obligation to compensate an accident victim for the loss of their vehicle, whether it concerns the time it takes to repair a car or the time it takes to purchase a replacement vehicle.  Much depends on which insurance company you are dealing with, but there are typically two scenarios to consider when thinking about rental vehicles.

The first scenario revolves around a situation when the car can be repaired.  Perhaps someone was rear-ended while sitting at a stop light.  The rear-fender is hanging off the back of the vehicle and a tail light is damaged.  The accident victim takes their vehicle to a repair shop, and the auto-mechanic determines it will take seven days to fix it.  Depending on the insurance company, the accident victim might be provided with a rental car for the seven days they are without their vehicle.  Typically, the bill for the rental car will either be sent directly to the insurance company, or the insurance company will send the accident victim a check for the entire cost.  If the victim cannot obtain a rental car  (no major credit card, victim is too young to rent, etc), or the insurance company does not deal directly with a rental car company, the victim should be compensated a reasonable cost for a seven-day rental.  The daily value depends on which insurance company is handling the claim, but can range anywhere from $10 – $20 per day.

The second scenario concerns a situation where an accident victim’s car has to be totaled.  The necessary repairs have exceeded 75-80% of the fair market value of the victim’s vehicle.  The insurance company has determined the car must be totaled.  Depending on the insurance company, they will pay for a rental car up to the date either: 1 – an estimate of the fair market value of the totaled vehicle is sent to the victim, or 2 – a check for a totaled vehicle is sent to the victim.  In some cases, an insurance company will compensate for a 1 – 3 days after the victim receives a check to allow a few days to purchase a new vehicle.
