Exceptions to Ohio’s Strict Liability Law for Dog Bites and Dog Attacks

Exceptions to Ohio Dog Bite LawsIn Ohio, a dog owner will be held strictly liable for any injuries caused by his or her dog.  There are two (2) exceptions to this general rule of strict liability:

(1). A dog owner will not be held liable for injuries caused by his or her dog if the injured person was trespassing on the dog owner’s property and;

(2)  A dog owner will not be held liable if the injured person was teasing, tormenting, or abusing the dog.

If a person is injured by a dog while committing or attempting to commit criminal trespass on the dog owner’s property, then the dog owner will not be held liable.  This exception extends to other criminal offenses as well.  If a person commits or attempts to commit any criminal offense, other than a minor misdemeanor, on the dog owner’s property, then the dog owner will not be held liable if that person is injured by the dog.  This exception, however, does not apply to persons engaging in door-to-door sales or other solicitations.  A dog owner will be held liable for injuries to solicitors caused by his or her dog.

Also, a dog owner will not be held liable for injuries to a person who teased, tormented, or abused the dog prior to being bitten.  This exception, however, does not extend to young children.  Courts in Ohio have found that children three years old and younger are incapable of teasing, tormenting, or abusing a dog as a matter of law.
