Common Law Marriage in Ohio

Common law marriage in OhioMany people in Ohio chose to live together instead of entering into a formal marriage.  People who live together, without the benefit of a formal marriage, may believe that they are in a common law marriage relationship. However, in 1991 the Ohio legislature disallowed common law marriage in the State of Ohio. Accordingly, if you were under the mistaken belief that you are in a common law marriage, you should be aware the Domestic Relations Laws in Ohio will not protect you in the event of a breakup. However, if your relationship began prior to 1991, you still may be in a common law marriage relationship, and if proven, the Domestic Relations Laws would be available to assist you in the event of a breakup.

If your relationship began after 1991 and you have acquired property with your significant other, either real or personal, your sole remedy is to file a civil action in an Ohio Civil Court to determine an equitable distribution of the real estate and any other personal property.
