Nursing Home Related Injuries While Being Transported in Vehicles

Nursing home injuries in transport vehiclesPerhaps the most common complaint by nursing home residents is that they feel they have lost their freedom. To combat this, some nursing homes plan day trips to places like museums or shopping malls. Although this gesture is appreciated by most residents, it presents some unique opportunities for injury.

One risk is that the person transporting the residents could get in a traffic accident. Because most nursing homes use large vans or buses for these occasions, the risk of an accident may actually be somewhat higher than normal. These large vehicles handle differently and have more blind spots than smaller cars. The average person has not driven this type of vehicle before. Nevertheless, these vehicles are sometimes entrusted to inexperienced workers.

Of course, any road trip poses some risk of traffic accidents, so this is not unique to nursing homes. However, the problems that arise when transferring elderly residents in and out of vehicles are unique. If residents are in wheelchairs or have trouble stepping up into a vehicle, the nursing home may have installed some sort of lift to help them.

These lifts, like any machinery, are at risk for breaking or malfunctioning, and this risk increases as they age (especially if they are not properly maintained). Sometimes minor problems are ignored because it is deemed too expensive to address them. For example, a wheelchair lift may start making strange sounds or shuddering when it used to run quietly and smoothly.

Nursing homes owe a standard of care to their residents, and they must prevent any foreseeable injuries. Being aware that a piece of equipment is dangerous but failing to fix it is not just unsafe. It is also a violation of the nursing home’s duty to its residents.

It is unfortunate that some nursing homes try to increase their profitability by cutting corners when it comes to maintenance.

Fortunately, there may be legal remedies available if you or a loved one were injured due to a nursing home’s negligence. For a free evaluation of your case, contact the Ohio nursing home lawyers Slater & Zurz LLP by calling 1-800-297-9191 or send a Blog Message to schedule a time to talk.
