Example of Nursing Home Abuse: Citation Issued by State Over Reports of Abuse

A Danville, Kentucky nursing home is appealing a citation issued by the state over reports of abuse by a staff member. Such a state citation indicates that a resident’s life had been placed in danger by act or neglect.

The citation stems from allegations that in 2010 an aide working at the Charleston Health Care Center assaulted a resident by trying to suffocate him with a pillow over the face. The aide also was alleged to have hit the resident in the head four times. The victim had been admitted to the facility with a head injury and schizophrenia.

Officials at the center claim that because of the resident’s mental state his claims appear not to be true. However, a medical assistant indicated that the resident had a small injury to the face that was not present prior to the alleged incident. Further, other staff members reported that the aide had acted inappropriately with various residents over a period of several months. They indicated the aide was “physically, mentally, and verbally rough” with residents and that he was seen kissing them.

An additional charge in the citation was that the facility did not appear to have conducted an investigation of the incidents in question, nor did it do anything to protect residents.

The attorney representing the nursing home said that there is nothing to substantiate the charges. She further contends that the facility has provided quality care to its residents for “a very long time.”

The Kentucky Attorney General’s office, which originally issued the citation, is reviewing the matter. Whether the allegations are true or not, abuse such as this occurs all too often in facilities.
