Example of Nursing Home Abuse: Bodily Harm of a Nursing Home Resident

St. Michael’s Lutheran Home was the scene of alleged abuse in August. The Fountain Valley,Wisconsin facility is home to a 93-year-old victim. A social worker came to interview her when it was discovered the victim had been punched in the head three times and had a large bruise.

Describing the punches she received as “biffs,” the elderly victim told the social worker that she would be hit after breakfast when she was returned to her room. Each morning when Hardesty moved her from her wheelchair she would be “biffed,” the elderly woman said. She went on to say that each time the defendant would enter her room she would be punched.

While the victim was describing the abuse, the nursing home worker charged with the abuse entered her room. After she left, the victim identified the nursing assistant as the person who struck her. The social worker reported the assault to police and an arrest was made.

The former nursing assistant was charged with felony intentional abuse causing bodily harm. While she denied the charges, she accepted a plea deal rather than face trial. In the deal, she does not have to admit wrong-doing. She was given 40 hours of community service, along with anger management classes.
