Nursing Home Abuse Case Example: Nursing Home Fined for Neglect and Mistreatment

Nursing Home Abuse CasesA Lake Placid, New York nursing home facility was recently fined over $20,000 for subjecting residents to neglect, mistreatment, and possible abuse. The Federal Centers for Medicare and Medicaid Services imposed the fine on Adirondack Medical Center—Uihlein months after a survey of the facility exposed incidents out of keeping with acceptable practices.

The allegations stem from two incidents. In one, a licensed practical nurse failed to provide care to a tracheostomy patient. She refused to suction the man, and would not allow him to call his mother. Suctioning is a normal and expected procedure for these patients, and is performed to help the patient breathe. In the end the patient was able to contact a friend through Facebook, indicating that he did not feel safe in the care of the nurse in question. While the supervising nurse ultimately did suction the patient, she did not reprimand the nurse in question.

The patient made an additional complaint later that a nurse practitioner removed his Passy-Muir valve. This made it impossible for him to speak.

Inspectors for the survey also cited staff for failing to investigate injuries to the face of another patient.

The facility administrator submitted a plan of corrective action in the case. In the report, he indicates that the one nurse was fired for “reasonable cause that abuse may have occurred.” He claimed in the same report that his staff took immediate measures.
