Wrongful Death Claimed in Nursing Home Lawsuit

Wrongful death of a loved one in Ohio nursing homeThe death of a 78-year-old nursing home resident has led to the filing of a wrongful death lawsuit. The suit claims that nurses failed to seek medical attention for the woman after she fell.

The deceased was considered a high fall risk, which required staff to take proactive measures to guard the woman’s safety. According to the lawsuit, a care plan was in place but wasn’t followed. By this plan the woman’s bed should have been kept in a low position, and floor mats should have been in place to soften a fall. Neither of these measures was taken, nor was a bed alarm used.

The lawsuit also contends that nurses were not adequately trained to deal with the woman’s injuries. She suffered neurological injuries and bleeding. Rather than call emergency personnel, nurses merely placed the woman back in her bed. She was later found unresponsive, and was then taken to the hospital, where she died.

Wrongful death charges also contend that the nursing facility has refused to release medical records to the deceased family’s attorneys, and has failed to produce the name of their own lawyers or contact information. The family earlier attempted to settle out of court for $275,000.
