Elder Abuse in Ohio Nursing Homes

Elder Abuse in Ohio nursing homes can take a number of different forms. The type of abuse will determine what kind of responsibility the nursing home will have to take for the abuse—criminal, civil, or both.

While elder abuse in Ohio is a crime, it may also come from circumstances where the nursing home may be sued for damages.

And, many times, elder abuse in nursing homes will give rise to both criminal and civil actions against the home.

If a nursing home employee, or the nursing home itself, has committed a crime, the nursing home may be prosecuted in criminal court by a local or state prosecutor.

There is a very good explanation of this process on the web page of the Ohio Attorney general here: http://www.ohioattorneygeneral.gov/services/seniors/elder-abuse

If a crime has been committed, our elder abuse and nursing home abuse attorneys can advise you on the proper steps to take in contacting the appropriate authorities.

At the same time, many circumstances of criminal elder abuse may also give rise to an action for civil damages against the nursing home. While money will not make the past abuse go away, monetary damages against a nursing home certainly will make that home think twice about repeating that behavior in the future.

In other words, you can sue them even if they have been charged with a crime.

Criminal acts that may also give rise to civil litigation include physical abuse, sexual abuse, and verbal abuse of the resident.

If these unfortunate events have happened to a loved one, please contact Slater & Zurz LLP at 1-800-297-9191 and speak with one of our experienced attorneys.  You can learn more about nursing home abuse and elder abuse by visiting our website at http://www.stopohionursinghomeabuse.com.
